Swimbrite - Terms & Conditions
1. Enrollment
  • As at the date of signature of these terms and conditions, your child is enrolled with Swimbrite for an indefinite period of time until such enrolment is provided for herein.[cite: 1]
  • Before any child’s lesson times can be reserved, this enrolment form must be completed and signed.
2. Deposit
  • A deposit in the amount of one month’s fees must be paid for each child, which is refundable when one (1) calendar month’s written notice is received as set out below or can be used for outstanding fees.
3. Terms and Operating Hours
  • The coaching year runs from January to December, excluding public holidays and Government school holidays.
  • The exact dates of the terms will be communicated to the parents/guardians.
  • Parents/guardians will be responsible for all fees, which will include the yearly admin fee, deposits, any further costs for goods or services, including but not limited to equipment, caps, goggles.
  • The parent/guardian is responsible for any costs incurred of any late payments.
  • Fees are only payable on a monthly or quarterly basis and never per lesson attended.
  • Termly/yearly fees must be paid at the start of each term. Full monthly instalment payments must reach us by the first of every month strictly via electronic transfer (EFT), debit or credit card.
  • No cheques or cash payments/deposits will be accepted.
  • Swimbrite reserves the right to allocate the payment of fees where it deems necessary in its sole and absolute discretion.
  • Fees are not prorated for loss of lessons at any time after your start month.
  • One (1) calendar month’s written notice must be given to notify Swimbrite of any changes to the account, which includes but is not limited to the child leaving the school, whether permanently or temporarily, as well as the changing of any lessons.
  • December month will not be accepted as a cancellation month.
  • Fees will continue to accumulate on your account up until proper cancellation has taken place, as set out herein.
  • The parent/guardian is responsible for any costs incurred in the collecting of any late payments.
  • Please note that fees will be reviewed once a year and increased if necessary.
  • The fees are subject to change upon one (1) calendar month’s notice.
  • There is no reduction in swimming fees in the event of cancellation of classes due to thunder and lightning.
  • Similarly, there is no reduction in fees in the event of non-attendances due to illness or any other reasons.
4. Late Payment of Fees
  • Where fees are not paid on time or withheld for any reason whatsoever, we reserve the right to refuse further lessons until payment is received.
  • Should a payment not reflect, a late payment administrative fee will be charged per month that your account remains unpaid.
  • Should Swimbrite institute legal proceedings against the parent/guardian responsible for the account, the relevant person will be liable for the cost of Swimbrite on an attorney and own client scale, plus collection commission.
  • You are urged to contact Swimbrite immediately to notify of your failure to pay and to advise when you will be able to make such payments.
5. Absence from Lessons
  • Should your children not attend swimming lessons for any reasons whatsoever, full fees are still payable.
  • Cancellation of lessons must be done at least five (5) hours before a lesson.
  • Catch up classes will only be arranged when children are sick and with a doctor’s letter.
  • Catch up lessons cannot be carried over and missed catch ups cannot be made up.
  • At all times, the instructor reserves the right to stop classes in the event of thunder and lightning only and not for mere rain.
  • In such a case no make-up classes will be allocated.
  • We will be offering dry swimming related classes when there are thunder and lightning. Other classes missed will be forfeited.
  • Swimbrite reserves the right to cancel classes from time to time, and these classes will be offered as a catch-up and may fall on a public holiday.
6. Notice and Addresses
  • All notices between parents and Swimbrite is to be in writing and sent via email to the address chosen above.
7. Legal Framework
  • Reservation of Other Rights: Swimbrite reserves the right to make, change, alter or amend its rules, with reason, from time to time and parent/guardian agree to abide by any such rule.
  • Waiver and Condonation: Any indulgence or condonation by Swimbrite shall not be construed as any waiver or novation of its rights in terms of this Agreement.
  • Severability: Each clause in this agreement is severable from the other, and in the event that any clause is invalid or unenforceable, same shall be capable of severability, and the balance of these clauses are to remain in force and effect.
Acknowledgment & Agreement

I, the undersigned, agree to be responsible and make payment of services rendered by SWIMBRITE. I agree to give one calendar month’s paid notice. I accept the terms and conditions as indicated here in.
